From April 2021, off-payroll (IR35) reforms are being introduced in the private sector. They will mean that the responsibility for IR35 status determination will switch from contractors to end hirers, with recruitment agencies facing liability for any unpaid tax. 

If you’re an agency, this means it’s time for you to act if you haven’t already done so.

Agencies and end hirers will need to take responsibility for conducting and issuing IR35 assessments accurately, though your agency will be the first port of call should HMRC challenge a contractor’s ‘outside’ IR35 status. This means you could face financial risks, so it’s important that you understand the changes and prepare your agency accordingly.
