From April 2021, off-payroll (IR35) reforms are being introduced in the private sector. They will mean that the responsibility for IR35 status determination will switch from contractors to end hirers, with recruitment agencies facing liability for any unpaid tax.

If you’re an agency, this means it’s time for you to act if you haven’t already done so.

Agencies and end hirers will need to take responsibility for conducting and issuing IR35 assessments accurately, though your agency will be the first port of call should HMRC challenge a contractor’s ‘outside’ IR35 status. This means you could face financial risks, so it’s important that you understand the changes and prepare your agency accordingly.

IR35 Assessments

At Crest Plus, we have an in-house assessment tool available to our agency partners. You can manage your workforce with complete assurance that every single contractor is working compliantly and in a working option that suits them.

Some benefits of our IR35 assessment tool include:

  • Easy to use, enabling your agency to manage contractor engagement from status determination to payroll provider.
  • Delivers results instantly, so you can assess your entire contingent workforce even during busy periods.
  • Provides clear and insurable results for each individual assignment.
  • Aligned with established case law and audited by independent experts.
  • Makes a firm judgement in borderline cases.
  • Can be white-labelled for agency use with end clients.
  • Meets HMRC’s requirements for valid Status Determination Statements.

Next steps

No matter which result your contractors receive following their status assessment, we’re here to help.

Some contractors will be able to continue operating ‘outside’ IR35 compliantly through their PSC. However, if previously ‘outside’ contractors receive an ‘inside’ determination under the new rules, Crest Plus has a well-established Umbrella Company to help contractors to continue contracting while guaranteeing complete compliance.

Crest Plus Umbrella

If you’re experiencing an increase in ‘inside’ IR35 contractors, our FCSA-accredited Umbrella service can take the admin and payroll responsibilities off your hands so you can focus on your core activities.

We’ve been operating Umbrella services since 1999, so we have the knowledge and experience to ensure your contractors’ umbrella payments are accurate and on-time, every time. We’ll work closely with your agency to ensure everything is done as it should be, and everyone is always operating compliantly – so you don’t have to worry about facing liability from HMRC.

Benefits of Crest Plus Umbrella include:

  • Free consultation to discuss whether Umbrella is the right choice for you.
  • Sample take-home pay calculation.
  • FCSA-accredited for guaranteed compliance.
  • Regular IR35 reassessments if required.
  • Contractors will receive all employment benefits including holiday pay, sick pay, pension scheme, maternity and paternity leave.
  • Easy for contractors to switch between assignments while building a record of continuous employment.
  • Personal accident insurance included as standard: we’ll cover your commute too.
  • A range of insurances such as Professional Indemnity (up to £5,000,000), Public Liability (up to £10,000,000), and Employers’ Liability (up to £10,000,000).
  • Access to a range of rewards and benefits from our specially selected partners.
  • Taxes and National Insurance contributions deducted at source, so contractors don’t have to worry about compliance or administrative responsibilities.
  • Security of payment.
  • Secure online portal for contractors to access their payments information.
  • Ongoing support and advice about any aspect of contracting.
